1. Definitions

In these Terms and Conditions the following definitions apply:

PowerShare
PowerShare V.O.F., registered with the Dutch Chamber of Commerce under number 99436280.

User
Any natural person who uses the services of PowerShare.

Service
The system provided by PowerShare that allows users to rent power banks through PowerShare stations.

Power Bank
The portable battery including the associated charging cables that is rented through a PowerShare station.

Station
The physical PowerShare device where power banks can be collected and returned.

2. Applicability

2.1 These Terms and Conditions apply to all services provided by PowerShare.

2.2 By using the service, the user agrees to these Terms and Conditions.

2.3 Deviations from these Terms and Conditions are only valid if confirmed in writing by PowerShare.

2.4 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

4. Access to the Service

4.1 The service is only available to individuals 18 years of age or older.

4.2 The user is responsible for all activities carried out through their account.

4.3 The user must provide accurate and up-to-date information during registration.

4.4 PowerShare reserves the right to suspend or terminate accounts in case of violation of these Terms and Conditions or misuse of the service.

5. Rental and Pricing

5.1 The rental period begins when a power bank is successfully removed from a PowerShare station.

5.2 The rental fee is calculated based on the actual duration of use according to the hourly rate displayed in the application or at the station.

5.3 The rental continues until the power bank is returned to a PowerShare station.

5.4 The maximum rental period is 72 hours.

5.5 Up to 72 hours after the start of the rental, only the applicable hourly rate will be charged.

6. Termination of the Rental

6.1 The rental ends when the power bank is properly returned to a PowerShare station.

6.2 If the power bank is not returned within 72 hours, the rental will automatically be terminated.

6.3 After termination of the rental period, no further hourly rental fees will be charged.

6.4 The period between 72 hours and 120 hours is considered a reasonable recovery period (“grace period”).

6.5 If the power bank is returned within this grace period, the rental will be closed without additional charges.

7. Non-Return and Loss

7.1 If the power bank is not returned within 120 hours after the start of the rental, the device will be considered lost.

7.2 In such case the user is required to:

  • pay the fixed compensation for loss of the device as stated in the price list;

  • pay any outstanding rental fees.

7.3 The due amounts may be automatically charged to the payment method provided by the user.

7.4 PowerShare reserves the right to block the user’s account in the event of non-return.

8. Damage to the Device

8.1 The user is responsible for the condition of the power bank from the moment of collection until proper return.

8.2 In case of minor damage, a compensation fee of 10 may be charged.

8.3 In case of serious damage, a compensation fee of 25 may be charged.

8.4 The assessment of damage will be based on technical inspection.

9. Payment

9.1 Payment for the service will be made through the payment method provided by the user during registration.

9.2 PowerShare is authorized to automatically charge the user for:

  • rental fees

  • damage compensation

  • loss of equipment

9.3 If a payment cannot be processed, PowerShare may temporarily suspend the user’s account until the outstanding balance is paid.

10. Use of the Service

10.1 The user must use the power bank with reasonable care.

10.2 It is strictly prohibited to:

  • open the power bank or station

  • make technical modifications

  • manipulate the system

  • use the service fraudulently

10.3 In case of misuse, PowerShare reserves the right to immediately terminate access to the service.

11. Evidence

11.1 Data registered by the PowerShare system shall serve as binding evidence of the rental period.

11.2 This includes, but is not limited to:

  • start time

  • end time

  • station location

  • duration of the rental

11.3 The user may provide counter-evidence if they believe the data is incorrect.

12. Objection Procedure

12.1 The user has the right to submit a written objection to any charged amount within 14 days after the payment has been processed.

12.2 PowerShare will review the objection within a reasonable time.

13. Liability

13.1 The use of the power bank and associated cables is entirely at the user’s own risk.

13.2 PowerShare shall not be liable for:

  • indirect damages

  • consequential damages

  • loss of data

  • loss of income

13.3 PowerShare shall not be liable for damages resulting from improper use of the device.

13.4 The total liability of PowerShare shall in all cases be limited to the amount paid by the user for the relevant rental.

14. Force Majeure

14.1 PowerShare shall not be liable for delays or failures resulting from force majeure.

14.2 Force majeure includes, but is not limited to:

  • technical failures

  • equipment defects

  • network interruptions

  • external circumstances beyond the control of PowerShare.

15. Privacy and Data Processing

15.1 Personal data will be processed in accordance with the General Data Protection Regulation (GDPR).

15.2 Data from blocked or terminated accounts will only be stored for administrative and legal obligations.

15.3 After the expiration of the legal retention period, personal data will be deleted or anonymized.

16. Modification of the Terms

17.1 PowerShare reserves the right to modify these Terms and Conditions.

17.2 The most recent version will always be published through the application or website.

17.3 Continued use of the service after changes to the Terms and Conditions constitutes acceptance of the revised terms.

18. Applicable Law and Disputes

18.1 These Terms and Conditions are governed exclusively by Dutch law.

18.2 Any disputes shall be submitted to the competent court in the Netherlands.
